TERMSCONDITIONS INTRODUCTIONTheServicecommenceswithaninitialvisittothepropertyinordertoagreeasuitablerentalvalueandtodiscussparticularspertainingtothepropertyandthelandlord.TherentquotedbyusonyourbehalfareinclusiveofanygroundrentservicechargesbuildingandcontentsinsurancefortheLandlordsownitems.Therentsquotedbyusonyourbehalfarenotinclusiveofgaselectricityoilandwaterratestelephonechargesandcounciltax.Oncewehavereceivedyourinstructionswepreparemarketingparticularsandstartmarketingtheproperty.Itisyourresponsibilitytoensurethatthepropertycomplieswithalltherelevantlegislation.Bylawallmachinesgasapplianceselectricalwiringandwhitegoodsshouldbeinfullworkingorder.Theyshouldalsohavebeenservicedandcheckedforsafetyinlinewithlegislationandhaveclearinstructionsforuse.Thepropertyshouldbethoroughlycleanedandgardensifapplicableshouldbeingoodseasonalcondition.WeshallaccompanyprospectiveTenantstoyourproperty.InexceptionalcircumstanceswemayarrangeforprospectiveTenantstomeetyouattheproperty.OncewehavefoundsuitableTenantsaHoldingDepositwillbetakenandtheprospectiveTenantsshallsignourApplicantsAgreement.YoushallbenotifiedbytelephonewhereverpossibleandorinwritingoremailthedetailsoftheofferandtheprospectiveTenantswillbedetailedandagreedwithyou.Weshallendeavourtotakeupreferencesandinformyouofthenatureofthecontentsofthereferencesandprovidecopiesofthemforyou.AlthoughweshallendeavourtoascertainthesuitabilityoftheTenantwerelyoninformationprovidedtousbythirdpartiesandwedonotguaranteeinanywaytheaccuracyorcompletenessoftheoftheinformationprovided.WeshallcollectadepositequaltoatleastonemonthsrentunlessotherwiseinstructedthedepositshallbelodgedinlinewithcurrentlegislationwithTheDepositProtectionServiceThePavilonsBridgewaterRoadBristolBS996AAWeuseanAssuredShortholdTenancyundertheHousingActasamendedbytheHousingAct1966AgreementandrelevantNoticesareavailableforinspectionpriortocommencementoftenancy.WeshouldbehappytoincludeadditionalclausesrequestedbyyourSolicitor.ShouldyoudecidetouseyourownAgreementadraftmustbemadeavailabletousattheearliestconvenience.ShouldyourownAgreementbeusedwecannotbeheldresponsibleforerrorsomissionsorfortheAgreementimplementation.UnlessinstructedbyyouweshallcontacttheTenantsnotlessthanonemonthpriortotheendoftheTenancytodeterminewhethertheywishtoremainatthepropertyandthenactontheirresponseaccordingly. RENTCOLLECTIONSERVICERentmanagementservicesincludestheletonlyservicebutdoesnotincludepropertymanagementservice.WeshallinformtheElectricGasandThamesWateroftheTenantsdetailstoensurethecorrectbillingtotheproperty.WeshallprovidetheLocalAuthoritywithalettersignedbytheTenantsandacopyoftheTenancyAgreementtoensurecorrectbillingtotheproperty.UnderSection21oftheHousingAct1988asamendedbytheHousingAct1996theLandlordisrequiredtoservenotlessthantwomonthswrittennoticewhenrequiringpossessionofthepropertypriortotheexpiryoftheterm.ShouldyourequirepossessionofthepropertyyoumustgiveuswritteninstructionatleasttwoweekspriortothenoticedeadlinetoservenoticeupontheTenants.Wecannotbeheldresponsibleforthedelayinregainingpossessionshouldyoufailtoprovidewritteninstructionswithinthespecifiedperiod.AnnualAccountsWeshallprepareanAnnualStatementofAccountscoveringtheyearending31stMarch.RentWarrantyInsupportofourserviceforvettingprospectivetenantsfinancialcovenantandgeneralcreditworthinessifitturnsoutthatatenantfallsintorentarrearsforwhateverreasonwewarrantythepaymentofcertainlimitedrentforyou.Intheeventthatwithin12monthsofthecommencementofthetenancyandprovidedthatthedateiswithin60daysoftheeffectivedateofthereferencecertificateandthatthedeposithasbeenlodgedwithin14daysofthecommencementoftenancywithoneoftheauthoriseddeposittakingbodiesthereisanydefaultinpaymentofthetenantsreferencedshareofthemonthlyrentorpartthereofwewillpaymonthlyinarrearsAnexcessequaltoonemonthsrentuptoamaximumof1800.00percalendarmonth.Uptoamaximumof8paymentsthefirstmonthsrentalbeingcollectedwithinthedepositandexcludingthefirstmonthofarrearsoruntiltheendofthefixedtermofthetenancyagreementwhicheverissoonest.Paymentswillbeproratatotheperioduntilvacation.IfthetenantvacatesthePropertythelastpaymentwillbeproratatothedateofvacation.PaymentswillbemadesubjecttoanydeductionsagreedintheTermsandConditions. PROPERTYMANAGEMENTSERVICEPropertyManagementServiceincludestheLetOnlyandRentManagementService.MaintenanceTheLandlordhasastatutoryresponsibilityfortheupkeepofthepropertypursuanttoSection11oftheLandlordandTenantAct1985.TheLandlordsresponsibilitiesunderthisActaretokeepingoodrepairthestructureofthepropertyincludingdrainsguttersdownpipesandtheexterior.Tokeepingoodrepairtheappliancesforsupplyofgas.Electricityandwatertotheproperty.Tokeepinrepairtheappliancesheatingsystemswatertanksandsanitaryappliancesoftheproperty.Weshalldealwiththedaytodayrepairsuptoamaximumof200.00includingVATperitem.Ifrepairorreplacementislikelytocostinexcessofthisfigureexceptinemergencywewillendeavourtocontactyouoryourrepresentativetoconfirmcostsinvolved.Inthecaseofanemergencyweshallauthorisetherepair.Wereservetherighttolevyasupervisionchargeof10plusVATwherethecostsexceeds1000.00.Inordertoprovidethisservicewerequireafloatof200.00ThiswillbedeductedfromtheinitialpaymentofrentandmaintainedattheagreedlevelfromsubsequentnetrentspassingfromtheTenantstoyou.Weareunabletoarrangeforworkspriortolettingunlessweholdsufficientfundstocoverthecost.CleaningWerecommendthatthepropertyisprofessionallycleanedpriortothecommencementofmarketingtheproperty.Wecanarrangethisonyourbehalf.Youshallberesponsibleforthecostswhichshallbedeductedagainstyourinitialrentalincomeuponlettingthepropertyshouldthepropertynotbeletbyusthecleaningshouldbepaidforwithin14daysofthedateoftheinvoice.PropertyInspectionWecanundertakepropertyinspectionsonyourbehalfduringtheTenancy.Theinspectionwillextendonlytoapparentdamagestofixturesfittingandtheexteriorstateofrepairandwillnotamountinanywaytoastructuralsurveyoftheproperty.Wecannotacceptresponsibilityforhiddenorlatentdefects.Weshalladvisetheoccupantsifinouropiniontheyarenottakingcorrectcareoftheproperty.acceptresponsibilityforhiddenorlatentdefects.Weshalladvisetheoccupantsifinouropiniontheyarenottakingcorrectcareoftheproperty. ADDITIONALSERVICESWecanarrangeaGasSafetyinspectionandCertificateonyourbehalf.WecanarrangeaEnergyPerformanceInspectionandCertificateonyourbehalf.Itisyourresponsibilitytoensureallrelevantconsentsareobtainedbeforeyourpropertyislet.Wherethepropertyissubjecttoamortgagethepriorpermissionofthemortgagemayberequiredtoletorsub-letthepropertyYoushouldcontactyourBuildingSocietyorBankassoonaspossible.Themortgageewillnormallywishtoseeacopyoftheproposedtenancyagreementandtheexecutedtenancyagreement.Yourmortgagecompanymaychargeafeefortheirapproval.IfyouareaTenantoraLesseeyoumayrequireconsenttosub-letyourpropertyfromthefreeholderthemanagingagentandoryourlandlord.YoushouldobtainwrittenconsentfromtherelevantpartywhomayrequireseeingacopyoftheTenantsreferencesWearehappytoarrangesuchconsentsbutmustbenotifiedinwritingofthefulldetailsandproceduresrequired.LegislationRegulationsItisyourresponsibilitytoensurethatthepropertyanditscontentscomplywithalltheapplicablelegislationandregulationsincludingwithoutlimitationtotheforegoingthoselistedbelowGasSafetyInstallationsandUseRegulation1994GasSafetyAsalandlordyouarelegallyobligedtohavethegassupplyandallgasappliancesinthepropertyinspectedannuallybyaGasSafeRegisteredEngineerandtosupplyacopyoftheGasSafetyCertificatetotheTenantspriortooratcommencementoftheTenancyandannuallythereafter.YoumustprovideacopyoftheGasSafetyRecordtousatleastthreeworkingdayspriortothecommencementofTenancyorauthoriseustoarrangethisGasSafetyInspectionCertificateatacostof90.00WhereweareinstructedtoorganiseaGasSafetyInspectionCertificateweshalldeductthecostfromtherentpayment.FireSafetyWitheffectfrom1stMarch1989itisacriminaloffencepunishablebyfineandorprisontermtoletapropertywithfurnitureandsoftfurnishingswhichcannotbeproventocomplywithFireResistancerequirementsasrequiredbytheaboveRegulations.Landlordsareadvisedtotaketheirownprofessionaladvicewithregardtothismatter.ElectricalEquipmentSafetyRegulation1994ElectricalEquipmentWitheffectfrom9thJanuary1995itisanoffencetosupplyelectricalequipmentthatisnotsafe.Asalandlordyoushouldensurethatboththeelectricalinstallationandelectricalequipmentprovidedinthepropertyaresafe.From1stJanuary1997allnewelectricalappliancesmustcarryaCEmarkandinstructionbookletorclearworkinginstructionsmustbeprovided.Newlyinstalledplugsandsocketsmustalsocomplywithregulations.Werecommendthatthesearetestedbyaqualifiedandapprovedelectrician. Section46ConsumerProjectionAct1994Itisanoffencetoletapropertywithacookerthatisdangerousinanyway.AgentsAuthorityWehavetheauthoritytoremovefurniturefurnishingselectricalappliancesandgasappliancesfromthepropertythatdonotcomplywithcurrentsafetylegislationandreplacetheitemsattheLandlordsexpensewithareasonableequivalent.NonResidentLandlords-TaxationWhereaLandlordgoesabroadforaperiodof6monthsormoretheAgentiftheycollectrentortheTenantsiftheypaytherentdirectlytotheLandlordisrequiredtodeducttaxdirectlyfromtherentandforwarditontotheInlandRevenueunlesstheLandlordhassoughtInlandRevenueapproval.IntheeventnosuchapprovalhasbeenprovidedtousandweareinstructedtocollectrentormanagethepropertytaxwillbedeductedattheprevailingrateandforwardedquarterlytotheInlandRevenue.Wedonotoffertaxadvice.InformationthatcanbesuppliedtotheInlandRevenueTheInlandRevenuemayrequestinformationregardingtenancydetailsincluderentlandlordsstenantsetc.Wearelegallyobligedtoprovidethisinformationandassuchweshallprovidethisinformationwithoutfurthernotice.AdditionalItemsIfyourpropertyisleaseholdtheremaybetermsinyourheadsuperiorleasethatmayneedtobepassedtoyourTenantsforthemtocomplyonyourbehalf.ThesetermswouldthenbeaddedtotheTenancyAgreementtoensureyouareprotected.ItisyourresponsibilitytosupplyuswithacompletecopyofanyrelevantheadsuperiorleaseandweshallattachthistotheTenancyAgreementinorderfortheTenantstobeawareofotherobligationstheymayneedtocomplywithinadditiontothosecontainedintheTenancyAgreement.Itisessentialthepropertyandthecontentsincludedintheinventoryareadequatelyinsuredandthatyourinsurersareawarethepropertyislet.Failingtodosomayinvalidateyourinsurancecover.YoumustalsoinformyourinsurersifthepropertyisemptyforperiodsgreaterthanthosespecifiedinyourInsurancePolicy.Wewillnotberesponsiblefortherenewalofyourinsurancecoverunlesswereceivewritteninstructiontodoso.TheTenantshasthelegalrighttorequestofyourpropertybuildinginsuranceandyouagreetosupplyuswithacopyforthispurpose.
